Sanofi commits to protect your personal data and implements all necessary means to ensure such protection, in accordance with its Privacy Policy. This Personal Data Protection Notice (“Notice”) will explain to you the purpose and the modalities by which Sanofi processes your personal data through this site www.campus.sanofi/th/ (and its related services accessed through or provided in relation to the site including without limitation virtual event facilities) (the "Site"). Please read this entire Notice before submitting information to Sanofi through the Site. Sanofi reserves the right, in its sole discretion, to modify, revise, delete and update the Privacy Policy from time to time. Sanofi will use reasonable endeavors to notify you in advance and in appropriate manner of any significant modifications to the terms of the Privacy Policy (e.g., by emailing to you the revised Privacy Policy with a new effective date) or by publishing the revised Privacy Policy on our website. Unless otherwise defined herein, capitalised terms used in this Notice shall have the same meanings as those defined in the Terms of Use.

What processing activities does this Notice cover?

This Notice outlines Sanofi-Aventis (Thailand) Ltd.’s (“Sanofi”, “we”, “us”, or “our”) policy and responsibilities on the collection, retention, use, transfer, disclosure and/or processing of your Personal Data (as defined under the Laws) on the Site, in accordance with the Personal Data Protection Act B.E.2562, its implementing rules and regulations and other applicable laws protecting the privacy of your Personal Data (“Laws”)

Validity and evolution of this Notice

By visiting and registering for access to the Site, and/or interacting with Sanofi with regard to the Site, you acknowledge that you have read and consent to the collection, retention, use, transfer, disclosure and/or processing by Sanofi of your Personal Data in the manner described in this Notice.  

This Notice may be modified by Sanofi, from time to time, in particular to adapt its terms to evolutions or changes of applicable legislations and/or to Sanofi’s practices. Sanofi will use reasonable endeavors to notify you in advance and in appropriate manner of such modifications to the Notice (e.g., by emailing to you the revised Notice with a new effective date) or by publishing the revised Notice on this page. We invite you to check this Notice periodically. By continuing to communicate with Sanofi or by continuing to use the Site and/or providing your Personal Data to Sanofi following the modifications to this Notice, this shall signify your acceptance of such modifications.

What personal data may be collected?

The following categories of Personal Data may be collected:

• For purposes of identification, (1) to verify that you are a registered healthcare professional (”HCP”) to enable you to access the Site you have registered for and use the Site, data may include, but is not limited to, your name, family name, title, email address, telephone number, specialty and/or sub-specialty, and Medical Council Registration (”MCR”) number; and (2) depending on the nature of your other interaction with Sanofi, data may include, but is not limited to, your name, family name, contact details (e.g., email address, telephone number, etc.), your professional information (e.g., job type, country, office address, business affiliations, affiliated organizations, training, position, etc.).
• Messages: any information you may send us in your requests, enquiries and/or correspondences with Sanofi by using this Site, or directly to Sanofi, by email, phone, online, electronic means, fax, post, or through you face to face interaction with Sanofi’s personnel or subcontractor or agent or by any other means with regard to the Site.
• Connection data: any information regarding your access to the Site (e.g., type of devices and browser used, timestamp of your connection, Internet protocol (IP) address, pages visited, browsing history, cookies, etc.). Generally, we do not link your IP address to anything that will enable us to identity you.
• Location data: information that may be provided by your machine and browser about your location if you allow such information to be shared with Sanofi.
• Information from surveys or polls: information that may be provided by you through your participation in surveys or polls via the Site or other communications with Sanofi, in connection with Sanofi’s products or services, services made available on the Site, including but not limited to the virtual event facilities.
• Information from content sharing: Information that may be provided by you during your participation in the virtual event facilities.
• Data from publicly available sources: including but not limited to, public hospital data, medical association websites and from Sanofi’s data suppliers which provide global reference databases of healthcare and related professionals.
• Data relating to and data which may be collected by cookies: Sanofi may use cookies on this Site to store some information on your computer to improve the quality of your visit to our Site. In some cases, this information will help us to tailor the content to your interests, or help us to avoid asking for the same information on repeat visits to the Site. For what purposes does this site collect, retain, use, transfer, disclosure and/or processing of your personal data?

Any processing of Personal Data must be implemented for a defined purpose. In this respect, the collection, retention, use, transfer, disclosure and/or processing of Personal Data on the Site is conducted for the following purposes:

• to provide and operate the Site and related services including (but not limited to) to administer and manage the Site, including your registration to access and view the Site and its content which are intended only for HCPs;
• to allow you to navigate this Site and personalize your browsing experience when using the Site. Sanofi may use cookies on this Site to store some information on your computer to improve the quality of your visit to our Site. In some cases, this information will help us to tailor the content to your preference, or help us to avoid asking for the same information on repeat visits to this Site. No personally identifiable information is available in this process.
• to compile statistical data on the use of our Site to track the total number of visitors to this Site, the number of visitors to each page of this Site, how visitors navigate through this Site and the domain names of visitor’s internet service providers for the purposes of evaluating and improving the Site.
• to verify that you are a registered healthcare professional and to provide you access to the Site; the Site and its contents are intended for registered HCPs only;
• to manage your online accounts , to send you related communications, to provide troubleshooting and technical support to you, to respond to your queries, applications, complaints, and feedback, to keep track of our interactions, such as when you contact us for information and support in connection with the Site;
• to carry out statistical analysis, research marketing and other purposes using aggregate or de-identified information which does not include information that identify a particular individual;
• to carry out survey or poll, to develop, improve or evaluate our products, services and customer experience;
• to carry out event coverage, evaluation and publicity purposes (which may be via photographs and videos taken through virtual event facilities);
• to comply with legal or regulatory obligations that apply to Sanofi; monitor safety; manage adverse events; carry out prevention and investigatory activities; carry out administrative formalities, registration, declarations or audits. For example, we may disclose information in response to court order, and other lawful requests by regulators and law enforcement, including responding to national security or law enforcement disclosure requirements.
• to respond to legal requests from administrative or judicial authorities, in accordance with applicable laws; comply with a subpoena, required registration, or legal process.
• to protect our rights and interests; protect the health, safety, and security of Sanofi personnel and premises; carry out internal audits, asset management, system and other business controls; manage business administration (finance and accounting, fraud monitoring and prevention); maintain the security of our services and operations; protect our rights, privacy, safety or property, to allow us to pursue available remedies or limit the damages that we may incur as necessary; to protect ourselves against possible fraudulent actions.
  Sanofi shall not collect, retain, use, transfer, disclose and/or process any such Personal Data unless you voluntarily choose to provide us with it, or give your consent, or unless such disclosure is permitted or required by applicable laws and regulations.
  It is voluntary for you to supply your Personal Data to us for the Purposes, however, should you refuse or withdraw your consent, we may not be able to (1) communicate with you with regard to the Site; and/or (2) provide you with access to the Site. If you delete or choose not to allow the use of cookies, some areas of our Site may not function properly or be accessible.
  By providing your Personal Data to register for the Site, you acknowledge that you have read and agree to the collection, retention, use, transfer, disclosure and/or processing by Sanofi of your Personal Data in the manner described in this Notice.

On what grounds does this site process your personal data?

Depending on the data processing at stake, Sanofi may process your Personal Data on either one of the following legal basis:

• your consent: where you have clearly expressed your approval of Sanofi’s processing of your Personal Data. In practice, this will generally mean that Sanofi will ask you to sign a document, or to fill-in an online “opt-in” form or to follow any relevant procedure to allow you to be fully informed and then either clearly accept or refuse the envisaged Personal Data processing. By navigating this Site and, if relevant, consenting to the processing of your Personal Data using cookies (as per our Cookie Policy).
• legal obligations applicable to Sanofi’s activities; for instance, Sanofi is required to implement pharmacovigilance procedures to monitor adverse effects of marketed products, which generally involves the collection and retention of personal data.
• the legitimate interest of Sanofi in the sense of the Laws. In such a case, Sanofi shall consider your fundamental rights and interests in determining whether the processing is legitimate and lawful.

Sanofi may, on a case-by-case basis, rely on other legal grounds, such as the protection of your vital interests, in accordance with the Laws.

The Site may contain links to third parties' websites. Please note that we are not responsible for the collection, retention, use, transfer, disclosure and/or processing of your Personal Data and any information by such third parties. If you provide information directly to such sites, the privacy policy and terms of service on those sites are applicable and we are not responsible for the information processing practices or privacy policies of such sites.

Where does the personal data come from? Sanofi will always collect personal data from trusted sources

Sanofi may collect your personal data from different sources:

• Data that you communicate to us through various media and communication channels, whether verbally or in writing, or via electronic means, or through registrations, or through direct and indirect interactions with Sanofi, or through your participation in the virtual events accessed through the Site. For example, data you provide to access the Site and related services on the Site, to send us a request for information, etc.
• Data that we collect automatically, for instance when following your interactions with our Site, platforms, through certain technologies, such as cookies.
• Data that we collect in accordance with the Laws from public sources available.
• Data that we obtain legally from third parties, for example, when we may need to confirm contact information or to verify licensure of HCPs. In such case, we generally receive such Personal Data from third-parties that are authorized to do so in the framework of their own privacy and data protection policies or in accordance with applicable laws.

Who has access to personal data?

For the purposes described above, Sanofi may need to share your Personal Data with the following authorized third parties, whether they are located overseas or in Thailand:

• Sanofi’s employees and its affiliates;
• Our partners (healthcare professionals and organizations, distributors, other members of the healthcare and pharmaceutical industry);
• Selected suppliers, service providers or vendors acting upon our instructions for website hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, auditing, etc.;
• Any professional advisors and external auditors, including without limitation, legal advisors, lawyers, financial advisors and consultants;
• Legal, governmental or administrative authorities, as required by applicable laws including laws outside your country of residence;
• Potential acquirers and other stakeholders in the event of a merger, legal restructuring operation such as, acquisition, joint venture, assignment, spin-off or divestitures.
• Other data processors which have entered into a data processing agreement with us to process your Personal Data strictly in accordance with our instructions.

In any case, Sanofi will require that such third-parties:

• undertake to comply with the Laws and the principles of this Notice;
• will only process the Personal Data for the purposes described in this Notice; and
• implement appropriate technical and organizational security measures designed to protect the integrity and confidentiality of your Personal Data.

Where personal data may be transferred? Sanofi will ensure that transfers of your personal data are safeguarded

Sanofi is a multinational organization with affiliates, partners and subcontractors and other authorized third parties described above located in many countries around the world. For that reason, Sanofi may need to transfer (via access, visualization, storage, etc.) your Personal Data in other jurisdictions for the purposes described above.

If your Personal Data is transferred to destination countries where the standard of protection available may not have an 'adequate standard of protection' as specified by the Laws, Sanofi shall ensure that adequate safeguards as required by the applicable laws of the overseas jurisdictions and suitable protection measures will be implemented.

In particular, for intra-group transfers of Personal Data implemented for clinical studies and pharmacovigilance purposes, Sanofi has implemented and shall apply its "Binding Corporate Rules" validated by the EU Data Protection Authorities. In any case, Sanofi's, and its Affiliates', collection, retention, use, transfer, disclosure and/or processing of your Personal Data will continue to be governed by this Notice.

By accessing and using this Site, you understand and consent to the transfer of your Personal Data out of Thailand as described herein.

How secure: Sanofi will implement security measures to protect your personal data

We have implemented a variety of technological and organizational procedures and measures to ensure the integrity and confidentiality of your Personal Data from unauthorized access, use and disclosure. These measures shall take into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons.

For instance, we store your Personal Data on servers that have various types of technical and physical access controls, which may include, for instance, if appropriate, encryption. We may also aggregate, pseudonymize or anonymize Personal Data to ensure that no personally identifiable information is communicated to third parties.

However, please be aware that there is always some risk involved when submitting data over the Internet and that Sanofi cannot guarantee that its websites are 100% safe from illegal tampering or “hacking.” Any data transmitted over the Internet may be at risk.

How long: We will retain your personal data for a maximum period of ten years and as long as necessary

Sanofi stores your Personal Data in secure operating environments, databases, and tools, which are only accessible to authorized Sanofi employees, agents, affiliates and third parties. Sanofi undertakes to observe generally accepted industry standards and practices in the storage of your Personal Data or as required by the Laws. Sanofi shall take the appropriate and reasonable, technical and organizational measures to ensure the required data security and to protect your Personal Data against unauthorized loss, access, use, modification, amendment, disclosure, deletion or processing. Sanofi shall require its employees, agents, affiliates, and third parties who process your Personal Data to similarly comply with the legal requirements under this Notice and the Laws.

Sanofi shall retain your Personal Data for a maximum period of ten (10) years for the operation of the Site, granting you access to the Site, and for as long as it is necessary for the above-mentioned purposes and as required by the Laws.

After the applicable period, or when Personal Data is no longer required, Sanofi, and/or its employees, agents, affiliates or third parties shall destroy, delete or dispose of the same in a secure manner, or anonymous your Personal Data following generally accepted industry standards and practices.

Your rights: Sanofi will ensure that you can exercise your rights pertaining to your personal data

You shall have the following rights under the Laws, subject to applicable legal requirements and exceptions:

1. Right to withdraw your consent: In cases where you have given your consent to us for the collection, retention, use, transfer, disclosure and/or processing of your Personal Data, you have the right to withdraw your consent at any time, unless there is an applicable restriction on the consent withdrawal, whether under the law or under a contract which give you certain benefits. However, such consent withdrawal would not retroactively affect the collection, retention, use, disclosure and/or processing of your Personal Data which has already been done prior to the consent withdrawal.
2. Right to access to and obtain a copy of your Personal Data: You have the right to request access to and obtain a copy of your Personal Data collected and retained by us. You may also request that we disclose to you the sources of your Personal Data which we collected without your consent (if any).
3. Right to data portability: To the extent applicable Laws, you have the right to obtain a copy of your Personal Data collected and retained by us in a format which is readable or generally usable by automatic tools or equipment and can be used or disclosed by automatic means. You may also request that we send or transfer your Personal Data in such format either to other data controllers if it can be done by automatic means or to you, provided that it is technically doable.
4. Right to object to the processing of your Personal Data: You have the right to object to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data based on Sanofi’s legitimate interests (unless Sanofi can demonstrate a compelling legitimate ground or such data collection, retention, use, transfer, disclosure and/or processing is required by Sanofi for the establishment or exercise of, compliance with, or defense against legal claims) or the collection, retention, use, transfer, disclosure and/or processing of your Personal Data is carried out in connection with direct marketing purposes.
5. Right to delete, destroy, or anonymise your Personal Data: You have the right to request that we delete, destroy, or anonymise your Personal Data collected and retained by us in cases where: (1) your Personal Data is no longer necessary in relation to the purposes for which it is collected, retained, used, transferred, disclosed and/or processed; (2) you have withdrawn your consent to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data and Sanofi does not have any other legal basis to carry out the same; (3) you have objected to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data and Sanofi has no right to reject your request; or (4) your Personal Data is unlawfully collected, retained, used, transferred, disclosed and/or processed.
6. Right to suspend the use of your Personal Data: You have the right to request a suspension of the use of your Personal Data under the following circumstances: (1) while Sanofi is correcting or updating your Personal Data; (2) when your personal data is unlawfully collected, retained, used, transferred, disclosed and/or processed but you choose the request a suspension of the use instead of deletion; (3) when your Personal Data is no longer necessary to be retained in relation to the purposes for which it is collected but you have the necessity to have it retained for the establishment or exercise of, compliance with, or defence against legal claims; or (4) while Sanofi is verifying whether it can your objection to process your Personal Data based on Sanofi’s legitimate interest.
7. Right to correct your Personal Data: If you discover that your Personal Data collected and retained by us is misleading, inaccurate, incomplete or outdated, you may request that we correct and/or update your personal data as appropriate.
8. Right to report non-compliance to the regulator: If you discover that Sanofi, or its employees, or affiliates, or third parties, or data processors violated or failed to comply with the Laws, you may report the same to the regulator pursuant to the regulations prescribed by the Personal Data Protection Commission.

If you do not wish for your Personal Data to be collected via cookies on the Site, you can erase cookies from your computer's hard drive or refuse to accept cookies by adjusting the settings on your Internet browser. Please refer to our Cookie Policy.

Your consent

By accepting this Notice, you confirm that you have read, understood and agreed to the terms and conditions as provided herein. • ข้อความ: ข้อมูลใด ๆ ที่ท่านอาจส่งให้เราผ่านทางคำขอ คำถาม และ/หรือ การติดต่อกับซาโนฟี่โดยใช้เว็บไซต์นี้ หรือติดต่อโดยตรงถึงซาโนฟี่ ทางอีเมล โทรศัพท์ ออนไลน์ วิธีการทางอิเล็กทรอนิกส์ โทรสาร ไปรษณีย์ หรือปฏิสัมพันธ์ต่อหน้ากับบุคลากรของซาโนฟี่ หรือผู้รับจ้างช่วง หรือตัวแทน หรือด้วยวิธีการอื่นที่เกี่ยวข้องกับเว็บไซต์นี้

• เพื่อบริหารจัดการบัญชีออนไลน์ของท่าน เพื่อติดต่อสื่อสารกับท่าน เพื่อแก้ไขปัญหาและให้การสนับสนุนด้านเทคนิคให้ท่าน เพื่อตอบสนองต่อข้อสอบถาม คำขอ ข้อร้องเรียน และความคิดเห็น เพื่อบันทึกการปฏิสัมพันธ์ของเรา เช่น เมื่อท่านติดต่อเราเพื่อขอข้อมูลและการสนับสนุนในการเชื่อมต่อกับเว็บไซต์
• เพื่อดำเนินการวิเคราะห์ทางสถิติ การวิจัย การตลาด และวัตถุประสงค์อื่น โดยใช้ข้อมูลรวมหรือข้อมูลที่ไม่ระบุตัวตน ซึ่งไม่รวมถึงข้อมูลที่ระบุตัวบุคคลโดยเฉพาะ

• เพื่อตอบสนองต่อข้อเรียกร้องทางกฎหมาย จากหน่วยงานเจ้าหน้าที่ฝ่ายปกครองหรือฝ่ายตุลาการ โดยเป็นไปตามกฎหมายที่ใช้บังคับ ปฏิบัติตามหมายศาล การลงทะเบียนที่จำเป็น หรือกระบวนการทางกฎหมาย
• เพื่อปกป้องสิทธิและผลประโยชน์ของเรา ปกป้องสุขภาพ ความปลอดภัยและความมั่นคงของบุคลากรและสถานที่ของซาโนฟี่ เพื่อดำเนินการตรวจสอบภายใน การบริหารจัดการสินทรัพย์ การควบคุมระบบและธุรกิจอื่น ๆ บริหารจัดการธุรกิจ (การเงินและการบัญชี การป้องกันและติดตามการฉ้อฉล) รักษาไว้ซึ่งความมั่นคงปลอดภัยของการบริการและการดำเนินการของเรา ปกป้องสิทธิ ความเป็นส่วนตัว ความปลอดภัย หรือทรัพย์สินของเรา เพื่อให้เราสามารถแสวงหาแก้ไขเยียวยาที่มีอยู่ หรือจำกัดความเสียหายที่อาจจะเกิดขึ้นเท่าที่จำเป็น เพื่อป้องกันเราจากการฉ้อฉลที่อาจจะเกิดขึ้น

ซาโนฟี่จะไม่ทำการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผล ข้อมูลใด ๆ เว้นแต่ว่าท่านเลือกที่จะส่งข้อมูลให้กับเราโดยสมัครใจ หรือท่านให้ความยินยอม หรืออย่างน้อยการเปิดเผยนั้นได้รับอนุญาตหรือเป็นไปตามที่กฎหมายหรือกฎเกณฑ์ที่ใช้บังคับกำหนด

เป็นความสมัครใจของท่านที่จะส่งมอบข้อมูลส่วนบุคคลของท่านให้กับเราตามวัตถุประสงค์  อย่างไรก็ตาม หากท่านเลือกที่จะไม่ให้หรือถอนความยินยอม เราอาจจะไม่สามารถ (1) ติดต่อสื่อสารกับท่านเกี่ยวกับเว็บไซต์ และ/หรือ (2) ให้ท่านเข้าถึงเว็บไซต์  ถ้าท่านลบหรือเลือกที่จะไม่ยินยอมให้ใช้คุกกี้ บางพื้นที่ของเว็บไซต์อาจทำงานไม่ถูกต้องหรือไม่สามารถเข้าถึงได้

เว็บไซต์นี้ใช้ฐานใดในการประมวลผลข้อมูลส่วนบุคคลของท่าน?

• ความยินยอมของท่าน โดยที่ท่านได้แสดงเจตนาให้ความยินยอมอย่างชัดแจ้งสำหรับการประมวลผลข้อมูลส่วนบุคคลของท่านโดยซาโนฟี่  ในทางปฏิบัติ กรณีโดยทั่วไปจะหมายถึงซาโนฟี่จะขอให้ท่านลงลายมือชื่อในเอกสาร หรือกรอกข้อมูลทางแบบฟอร์ม “เข้าร่วม” ออนไลน์ หรือดำเนินการตามขั้นตอนที่เกี่ยวข้องเพื่อให้ท่านได้รับการแจ้งอย่างครบถ้วน จากนั้นจึงสามารถยอมรับหรือปฏิเสธการประมวลผลข้อมูลส่วนบุคคลที่กล่าวถึง  โดยการสำรวจเว็บไซต์นี้ (ถ้าหากเกี่ยวข้อง) ยินยอมให้ประมวลผลข้อมูลส่วนบุคคลของท่านโดยใช้คุกกี้ (ตามนโยบายคุกกี้ของเรา)
• การปฏิบัติตามกฎหมายที่ใช้บังคับกับกิจการของซาโนฟี่ เช่น ซาโนฟี่จำเป็นต้องดำเนินขั้นตอนการเฝ้าระวังเภสัชภัณฑ์เพื่อติดตามผลกระทบของผลิตภัณฑ์ที่วางตลาด ซึ่งโดยทั่วไปแล้วต้องมีการเก็บรวบรวมและการเก็บรักษาข้อมูลส่วนบุคคล

ขึ้นอยู่กับแต่ละกรณี ซาโนฟี่อาจจะอ้างถึงฐานทางกฎหมายอื่น เช่น ปกป้องผลประโยชน์อันสำคัญต่อชีวิตของท่าน ตามที่กฎหมายบัญญัติ

การเชื่อมโยงไปยังเว็บไซต์ของบุคคลที่สาม

ซาโนฟี่อาจเก็บรวบรวมข้อมูลส่วนบุคคลจากหลายแหล่ง:

• ข้อมูลที่ท่านให้ไว้แก่เราผ่านสื่อและช่องทางการสื่อสารต่าง ๆ ไม่ว่าทางวาจาหรือโดยลายลักษณ์อักษร หรือทางระบบอิเล็กทรอนิกส์ หรือผ่านทางการลงทะเบียน หรือผ่านปฏิสัมพันธ์กับซาโนฟี่ไม่ว่าทางตรงหรือทางอ้อม หรือผ่านทางการเข้าร่วมกิจกรรมเสมือนของท่านที่ได้เข้าถึงผ่านทางเว็บไซต์ เช่น ข้อมูลที่ท่านส่งมอบเพื่อใช้สำหรับการเข้าถึงเว็บไซต์และบริการที่เกี่ยวข้องบนเว็บไซต์ หรือเพื่อส่งคำร้องขอข้อมูลจากเรา ฯลฯ
• ข้อมูลที่เราเก็บรวบรวมโดยอัตโนมัติ โดยทันทีเมื่อท่านมีปฏิสัมพันธ์กับเว็บไซต์ แพลตฟอร์ม ผ่านทางเทคโนโลยีบางอย่าง เช่น คุกกี้
• ข้อมูลที่ซาโนฟี่เก็บรวบรวมตามกฎหมายจากแหล่งข้อมูลที่เปิดเผยต่อสาธารณะ
• ข้อมูลที่เราได้รับโดยถูกต้องตามกฎหมายจากบุคคลที่สาม เช่น เราอาจจำเป็นต้องยืนยันข้อมูลการติดต่อ หรือตรวจสอบใบอนุญาตของบุคลากรวิชาชีพสาธารณสุข (HCP)  ในกรณีดังกล่าว เราจะได้รับข้อมูลส่วนบุคคลดังกล่าวจากบุคคลที่สามที่ได้รับอนุญาตให้กระทำการดังกล่าวภายในขอบเขตของนโยบายความเป็นส่วนตัวและคุ้มครองข้อมูลส่วนบุคคลของบุคคลที่สามเหล่านั้น หรือตามกฎหมายที่ใช้บังคับ

ใครที่สามารถเข้าถึงข้อมูลส่วนบุคคลได้บ้าง?

เพื่อวัตถุประสงค์ที่ระบุในประกาศฉบับนี้ ซาโนฟี่อาจแบ่งปันข้อมูลส่วนบุคคลของท่านกับบุคคลที่สามที่ได้รับอนุญาตดังต่อไปนี้ ไม่ว่าจะอยู่นอกประเทศหรือในประเทศไทย

• พนักงานและบริษัทในเครือของซาโนฟี่
• พันธมิตรของเรา (บุคลากรวิชาชีพและองค์กรทางด้านสาธารณสุข ผู้จัดจำหน่าย สมาชิกอื่น ๆ ของอุตสาหกรรมการสาธารณสุขและเภสัชกรรม) 
• ผู้จัดหาสินค้า ผู้ให้บริการหรือผู้ขายที่ดำเนินการตามคำสั่งของเราที่ถูกเลือกสำหรับบริการเว็บไซต์โฮสติ้ง (website hosting) การวิเคราะห์ข้อมูล เทคโนโลยีสารสนเทศ และการจัดหาโครงสร้างพื้นฐานที่เกี่ยวข้อง บริการลูกค้า การรับส่งอีเมล การตรวจสอบ ฯลฯ 
• ที่ปรึกษามืออาชีพและผู้ตรวจสอบบัญชีภายนอก รวมถึงแต่ไม่จำกัดเพียง ที่ปรึกษาทางกฎหมาย ทนายความ ที่ปรึกษาทางการเงินและผู้ให้คำปรึกษา
• เจ้าพนักงานฝ่ายกฎหมาย ราชการ หรือฝ่ายปกครอง ตามที่กำหนดโดยกฎหมายที่ใช้บังคับ รวมถึงกฎหมายของประเทศอื่นนอกเหนือไปจากประเทศที่ท่านอาศัยอยู่
• บุคคลที่มีความเป็นไปได้ในการซื้อกิจการ และผู้เกี่ยวข้องอื่น ๆ ในกรณีของการควบรวมกิจการ การปรับโครงสร้างธุรกิจตามกฎหมาย เช่น การเข้าซื้อกิจการ การร่วมทุน การมอบหมาย การแยกกิจการบางส่วนหรือขายกิจการ
• ผู้ประมวลผลข้อมูลส่วนบุคคลรายอื่นที่เข้าทำสัญญาการประมวลผลข้อมูลส่วนบุคคลกับเรา เพื่อประมวลผลข้อมูลส่วนบุคคลของท่านภายใต้คำสั่งของเราอย่างเคร่งครัด

ไม่ว่าในกรณีใด ๆ ซาโนฟี่จะกำหนดให้บุคคลที่สามดังกล่าวดำเนินการดังต่อไปนี้

• ดำเนินการให้เป็นไปตามกฎหมาย และตามหลักการของประกาศฉบับนี้
• จะต้องดำเนินการประมวลผลข้อมูลส่วนบุคคลตามวัตถุประสงค์ที่กำหนดไว้ในประกาศฉบับนี้
• จัดให้มีมาตรการรักษาความปลอดภัยทางเทคนิคและองค์กรที่เหมาะสม โดยออกแบบเพื่อป้องกันความครบถ้วนสมบูรณ์และเป็นความลับของข้อมูลส่วนบุคคลของท่าน

ข้อมูลส่วนบุคคลอาจจะถูกโอนไปยังที่ใด? ซาโนฟี่จะทำให้มั่นใจได้ว่าการโอนข้อมูลส่วนบุคคลของท่านได้รับความคุ้มครอง

ซาโนฟี่เป็นองค์กรระหว่างประเทศซึ่งมีบริษัทในเครือ พันธมิตร ผู้รับจ้างช่วง และบุคคลที่สามที่ได้รับการแต่งตั้งอื่น ๆ ตามที่กำหนดข้างต้นอยู่ในหลายประเทศทั่วไป  ด้วยเหตุผลดังกล่าว ซาโนฟี่อาจจำเป็นต้องโอน (ผ่านการเข้าถึง การทำให้เห็นภาพ การจัดเก็บ ฯลฯ) ข้อมูลส่วนบุคคลของท่านในเขตอำนาจตามกฎหมายอื่น ๆ เพื่อวัตถุประสงค์ที่กำหนดไว้ข้างต้น
หากข้อมูลส่วนบุคคลของท่านถูกโอนไปยังประเทศปลายทางที่อาจไม่มีมาตรฐานการควบคุมข้อมูลส่วนบุคคลที่ “เพียงพอ” ตามมาตรฐานความคุ้มครองข้อมูลส่วนบุคคลที่กฎหมายกำหนด ซาโนฟี่จะจัดให้มีการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอตามที่กฎหมายของประเทศปลายทางกำหนด และมีมาตรการคุ้มครองที่เหมาะสม

ซาโนฟี่จะเก็บรักษาข้อมูลส่วนบุคคลของท่านเป็นเวลาไม่เกินสิบ (10) ปี เพื่อจุดประสงค์ในการทำการจัดเก็บบันทึกข้อมูล และจะเก็บรักษาข้อมูลส่วนบุคคลไว้นานตราบเท่าที่จำเป็นต่อวัตถุประสงค์ที่กล่าวข้างต้นและเท่าที่กฎหมายและกฎเกณฑ์ต่าง ๆ กำหนด
หลังจากระยะเวลาที่เกี่ยวข้อง หรือเมื่อไม่จำเป็นต้องใช้ข้อมูลส่วนบุคคลนั้นอีกต่อไปแล้ว ซาโนฟี่และ/หรือพนักงาน ตัวแทน บริษัทในเครือหรือบุคคลที่สามจะทำลาย ลบ หรือกำจัดข้อมูลส่วนบุคคลดังกล่าวอย่างปลอดภัย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวตนท่านได้ โดยยึดตามมาตรฐานและหลักปฏิบัติที่เป็นที่ยอมรับโดยทั่วไป

สิทธิของท่าน: ซาโนฟี่จะทำให้มั่นใจได้ว่าท่านสามารถใช้สิทธิที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของท่านได้

ท่านมีสิทธิตามกฎหมายดังต่อไปนี้ ภายใต้เงื่อนไขและข้อยกเว้นทางกฎหมายที่ใช้บังคับ

1. สิทธิที่จะถอนความยินยอมของท่าน: ในกรณีที่ท่านได้ให้ความยินยอมแก่เราเพื่อทำการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน ท่านมีสิทธิที่จะถอนความยินยอมเสียเมื่อใดก็ได้ เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอม ไม่ว่าจะโดยกฎหมายหรือสัญญาที่ให้ประโยชน์บางอย่างแก่ท่าน อย่างไรก็ตาม การถอนความยินยอมจะไม่ส่งผลกระทบย้อนหลังต่อการเก็บรวบรวม เก็บรักษา ใช้ เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่านที่ได้กระทำไปแล้วก่อนการถอนความยินยอม
2. สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน: ท่านมีสิทธิที่จะขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมและเก็บรักษาไว้ ท่านยังสามารถที่จะขอให้เราเปิดเผยถึงแหล่งที่มาของข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมโดยที่ท่านไม่ได้ให้ความยินยอม (ถ้ามี)
3. สิทธิในการย้ายข้อมูล: ภายใต้ขอบเขตที่กฎหมายกำหนด ท่านมีสิทธิที่จะขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวมและเก็บรักษาไว้ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติและสามารถใช้หรือเปิดเผยได้ด้วยวิธีการอัตโนมัติ ท่านยังสามารถขอให้เราส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นหรือให้แก่ท่าน เมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ หากว่าโดยสภาพทางเทคนิคสามารถทำได้
4. สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคลของท่าน: ท่านมีสิทธิที่จะคัดค้านการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน ภายใต้เหตุอันชอบด้วยกฎหมายของซาโนฟี่ (เว้นแต่ว่าซาโนฟี่สามารถพิสูจน์ให้เห็นถึงเหตุอันชอบด้วยกฎหมายที่ใช้บังคับสำหรับการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผล นั้นมีความจำเป็นสำหรับซาโนฟี่เพื่อก่อตั้งสิทธิเรียกร้อง การใช้สิทธิเรียกร้องหรือการปฏิบัติตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย) หรือการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่านได้ถูกดำเนินการเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
5. สิทธิในการลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวตนท่านได้: ท่านมีสิทธิที่จะขอให้เราดำเนินการลบ หรือทำลาย หรือทำให้ไม่สามารถระบุตัวตนท่านได้ สำหรับข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมและเก็บรักษาไว้ โดยเมื่อ (1) ข้อมูลส่วนบุคคลของท่านหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผล (2) ท่านถอนความยินยอมในการการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน และซาโนฟี่ไม่มีอำนาจอันชอบด้วยกฎหมายที่จะกระทำการดังกล่าวต่อไป (3) ท่านคัดค้านเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน และซาโนฟี่ไม่มีสิทธิในการปฏิเสธคำขอของท่าน หรือ (4) ข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลโดยไม่ชอบด้วยกฎหมาย
6. มีสิทธิในระงับการใช้ข้อมูลส่วนบุคคลของท่าน: ท่านมีมีสิทธิขอให้ระงับการใช้ข้อมูลส่วนบุคคลของท่านได้ภายใต้กรณีดังต่อไปนี้ (1) ในขณะที่ซาโนฟี่อยู่ระหว่างการแก้ไขหรือทำให้ข้อมูลส่วนบุคคลของท่านถูกต้องเป็นปัจจุบัน (2) ข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลโดยไม่ชอบด้วยกฎหมาย แต่ท่านขอให้ระงับการใช้แทนการลบ (3) เมื่อข้อมูลส่วนบุคคลของท่านไม่มีความจำเป็นอีกต่อไปในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล แต่ท่านมีความจำเป็นต้องขอให้เก็บรักษาไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การใช้สิทธิเรียกร้องหรือการปฏิบัติตามตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือ (4) เมื่อซาโนฟี่อยู่ในระหว่างการตรวจสอบเพื่อปฏิเสธคำคัดค้านการประมวลผลข้อมูลส่วนบุคคลของท่าน ภายใต้เหตุอันชอบด้วยกฎหมายของซาโนฟี่
7. สิทธิในการแก้ไขข้อมูลส่วนบุคคลของท่าน: เมื่อท่านพบว่าข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวมและเก็บรักษาไว้นั้นก่อให้เกิดความเข้าใจผิด ไม่ถูกต้อง ไม่สมบูรณ์ หรือไม่เป็นปัจจุบัน ท่านสามารถที่จะขอให้เราทำการแก้ไข และ/หรือทำให้ข้อมูลส่วนบุคคลของท่านถูกต้องเป็นปัจจุบันตามเหมาะสม
8. สิทธิร้องเรียนในกรณีที่มีการปฏิบัติไม่ถูกต้องต่อหน่วยงานรัฐที่มีอำนาจควบคุม: เมื่อท่านพบว่าซาโนฟี่ หรือพนักงานของซาโนฟี่ หรือบริษัทในเครือ หรือบุคคลที่สาม หรือผู้ประมวลผลข้อมูล ฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมาย ท่านสามารถรายงานการกระทำดังกล่าวต่อหน่วยงานรัฐที่มีอำนาจควบคุมตามกฎเกณฑ์ที่กำหนดโดยคณะกรรมการคุ้มครองข้อมูลสวนบุคคล

ถ้าท่านไม่ประสงค์ให้ข้อมูลส่วนบุคคลของท่านถูกจัดเก็บผ่านทางคุกกี้บนเว็บไซต์ ท่านสามารถลบคุกกี้ได้จากฮาร์ดไดรฟ์ของคอมพิวเตอร์ของท่าน หรือปฎิเสธการยินยอมคุกกี้โดยปรับการตั้งค่าอินเทอร์เน็ตเบราว์เซอร์ของท่าน โปรดอ่านนโยบายคุกกี้ของเรา

ความยินยอมของท่าน

Our personal data protection notice

This Personal Data Protection Notice ("Notice") describes how Sanofi-Aventis (Thailand) Ltd., and its Affiliates (as defined below) (each and collectively referred to as "Sanofi", "we", "our" or "us") collects, retains, uses, transfers, disclose and/or processes your Personal Data (as defined below) ("you" or "your"), in order to protect the privacy of your Personal Data.

Sanofi is committed to fully complying with the Personal Data Protection Act, B.E. 2562 (2019), its implementing rules and regulations and other applicable laws protecting the privacy of your Personal Data ("Laws"), and therefore kindly seeks your voluntary consent for Sanofi to collect, retain, use, transfer, disclose and process your Personal Data in accordance with the Laws, this Notice and Sanofi's privacy policy [URL Link: https://www.sanofi.com/en/our-responsibility/sanofi-global-privacy-policy] (the "Privacy Policy") for the purposes described in this Notice. Sanofi reserves the right, in its sole discretion, to modify, revise, delete and update the Privacy Policy from time to time. Sanofi will use reasonable endeavors to notify you in advance and in appropriate manner of any significant modifications to the terms of the Privacy Policy (e.g., by emailing to you the revised Privacy Policy with a new effective date) or by publishing the revised Privacy Policy on our website.

For the purposes of this Notice, "Personal Data" means any information relating to a person, which enables the identification of such person, whether directly or indirectly as defined by the Laws. "Affiliates" means (i) Sanofi Pasteur Ltd., (ii) Sanofi Winthrop (Thailand) Ltd., (iii) Opella Healthcare (Thailand) Ltd. and (iv) any corporation or entity controlled by, controlling or under common control with Sanofi-Aventis (Thailand) Ltd. The terms "controlling", "controlled by" or "control" shall mean (a) the direct or indirect ownership of more than fifty percent (50%) of the voting securities of such corporation or entity, or (b) the power to direct or cause the direction of the management or policies of such corporation or entity through the ownership of securities or interests, by contract or otherwise.

Should you refuse to provide your Personal Data, or your consent to Sanofi to collect, retain, use, transfer, disclose or process your Personal Data, Sanofi may not be able to communicate with you or to respond to any of your requests for information on Sanofi's products and services.

Type of data collected and how data is collected

The Personal Data collected by Sanofi includes information about you that you communicate with us, whether face-to-face, by phone, in writing including via email, or online, or via electronic means. Such information may include, but is not limited to first name, family name, phone number, residential address, office address, email address, professional information and experience (e.g., specialty, training, workplace and affiliated organizations, position, etc.), technical information relating to your devices (e.g., IP address, IMIE, cookie, etc.) and any information that you choose to share with us, which may be considered Personal Data.

Sanofi may collect your Personal Data from different sources, including:

1. Information that you communicate to us through various media and communication channels, whether verbally or in writing, or via electronic means or through direct or indirect interactions with Sanofi, such as event registration, your requests to Sanofi for information, your experience received from Sanofi's products and/or services, website, platforms, and cookies;
2. Information that Sanofi collects, in accordance with the Laws, from publicly available sources, such as data that is published by you; and
3. Information that Sanofi legally obtains from third parties who are authorized to collect, retain, use, transfer, disclose or process your Personal Data in accordance with applicable laws.

Purposes of the collection, retention, use, transfer, disclosure and processing of your personal data

Sanofi and its Affiliates (and any third party who may be acting on our behalf) may collect, retain, use, transfer, disclose, and/or process your Personal Data, for the purposes as permitted by applicable Laws and for the following purposes:

1. To comply with legal or regulatory obligations that apply to Sanofi, monitor product safety, manage adverse events and product complaints, comply with regulations, guidelines, codes of practice, transparency and reporting obligations, and to validate information;
2. To carry out prevention and investigatory activities and corrective action, including as requested by governmental officials, with respect to Sanofi's business, products and services, and assessing compliance with the Laws;
3. To carry out our business operations, including to communicate with you regarding sales, special offers, promotions, notices, news, and information about Sanofi's products and services, respond to your requests, provide you with access to medical and scientific information, events, meetings and online services, and plan, conduct and evaluate marketing & business performance and activities;
4. To carry out our legal and contractual obligations to you, such as, processing payments, keeping track of our interactions and meetings, including when you contact us for feedback, information and support;
5. To conduct research and development, including to carry out clinical studies, registries and trials, offer special programs, activities, trials, events or promotions via our services;
6. To carry out market or consumer studies, identify and analyze business and usage trend, improve and develop Sanofi's business, products and services, to make improvements to our provision of Sanofi's services and products.

Data transfer and processing by third parties

Sanofi collects and thereafter shares and processes your Personal Data with its employees and Affiliates, only for the purposes set out in this Notice. We will take the steps to ensure that access to Personal Data is restricted to Sanofi’s employees and third parties on a need-to-know basis.

Sanofi may share your Personal Data to third parties, for the purposes set out in this Notice, including, amongst others:

1. Business partners, service providers, agents or contractors, entities and individuals which are, or will be, engaged by Sanofi or its Affiliates, or performing services on behalf of Sanofi, its Affiliates, or our business partners;
2. Others, in the event of any reorganization, merger, business transfer, whether in whole or in part, sale, purchase, joint venture, assignment, transfer or other disposition of all or any portion of Sanofi's business, assets or stock or similar transaction;
3. External advisors, including lawyers, technicians and auditors who assist in running our business, and defending or bringing any legal claims;
4. Other data processors which have entered into a data processing agreement with us to process your Personal Data strictly in accordance with our instructions; and

The said third parties may be provided with access to Personal Data needed to perform their functions, but they may not use such Personal Data other than on our behalf and subject to contracts between Sanofi or its Affiliates and the relevant third party, that protects the confidentiality of your Personal Data.

International transfer of personal data

For the purposes hereof, your Personal Data may be transferred to Sanofi's overseas Affiliates, authorized employees, service providers, third parties located outside of Thailand, and information technology facilities and servers overseas, subject to applicable requirements under the Laws.

In particular, for intra-group transfers of Personal Data implemented for clinical studies and pharmacovigilance purposes, Sanofi has implemented and shall apply its "Binding Corporate Rules" validated by the EU Data Protection Authorities. In any case, Sanofi's, and its Affiliates', collection, retention, use, transfer, disclosure and/or processing of your Personal Data will continue to be governed by this Notice.

If your Personal Data is transferred to destination countries where the standard of protection available may not have an 'adequate standard of protection' as specified by the Laws, Sanofi shall ensure that adequate safeguards as required by the applicable laws of the overseas jurisdictions and suitable protection measures will be implemented.

Storage/retention/disposal/destruction/anonymization of data

Sanofi stores your Personal Data in secure operating environments, databases, and tools, which are only accessible to authorized Sanofi employees, agents, Affiliates and third parties. Sanofi undertakes to observe generally accepted industry standards and practices in the storage of your Personal Data or as required by the Laws. Sanofi shall take the appropriate and reasonable, technical and organizational measures to ensure the required data security and to protect your Personal Data against unauthorized loss, access, use, modification, amendment, disclosure, deletion or processing. Sanofi shall require its employees, agents, Affiliates, and third parties who process your Personal Data to similarly comply with the legal requirements under this Notice and the Laws.

Sanofi shall retain your Personal Data for a maximum period of ten (10) years for record purposes, and for as long as it is necessary for the above-mentioned purposes and as required by the Laws and rules.

After the applicable period, or when Personal Data is no longer required, Sanofi, and/or its employees, agents, Affiliates or third parties shall destroy, delete or dispose of the same in a secure manner, or anonymize your Personal Data following generally accepted industry standards and practices.

Your rights as a data subject

You shall have the following rights under the Laws, subject to applicable legal requirements and exceptions:

1. Right to withdraw your consent: In cases where you have given your consent to us for the collection, retention, use, transfer, disclosure and/or processing of your Personal Data, you have the right to withdraw your consent at any time, unless there is an applicable restriction on the consent withdrawal, whether under the law or under a contract which give you certain benefits. However, such consent withdrawal would not retroactively affect the collection, retention, use, disclosure and/or processing of your Personal Data which has already been done prior to the consent withdrawal.
2. Right to access to and obtain a copy of your Personal Data: You have the right to request access to and obtain a copy of your Personal Data collected and retained by us. You may also request that we disclose to you the sources of your Personal Data which we collected without your consent (if any).
3. Right to data portability: To the extent applicable Laws, you have the right to obtain a copy of your Personal Data collected and retained by us in a format which is readable or generally usable by automatic tools or equipment and can be used or disclosed by automatic means. You may also request that we send or transfer your Personal Data in such format either to other data controllers if it can be done by automatic means or to you, provided that it is technically doable.
4. Right to object to the processing of your Personal Data: You have the right to object to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data based on Sanofi’s legitimate interests (unless Sanofi can demonstrate a compelling legitimate ground or such data collection, retention, use, transfer, disclosure and/or processing is required by Sanofi for the establishment or exercise of, compliance with, or defense against legal claims) or the collection, retention, use, transfer, disclosure and/or processing of your Personal Data is carried out in connection with direct marketing purposes.
5. Right to delete, destroy, or anonymise your Personal Data: You have the right to request that we delete, destroy, or anonymise your Personal Data collected and retained by us in cases where: (1) your Personal Data is no longer necessary in relation to the purposes for which it is collected, retained, used, transferred, disclosed and/or processed; (2) you have withdrawn your consent to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data and Sanofi does not have any other legal basis to carry out the same; (3) you have objected to the collection, retention, use, transfer, disclosure and/or processing of your Personal Data and Sanofi has no right to reject your request; or (4) your Personal Data is unlawfully collected, retained, used, transferred, disclosed and/or processed.
6. Right to suspend the use of your Personal Data: You have the right to request a suspension of the use of your Personal Data under the following circumstances: (1) while Sanofi is correcting or updating your Personal Data; (2) when your personal data is unlawfully collected, retained, used, transferred, disclosed and/or processed but you choose the request a suspension of the use instead of deletion; (3) when your Personal Data is no longer necessary to be retained in relation to the purposes for which it is collected but you have the necessity to have it retained for the establishment or exercise of, compliance with, or defence against legal claims; or (4) while Sanofi is verifying whether it can your objection to process your Personal Data based on Sanofi’s legitimate interest.
7. Right to correct your Personal Data: If you discover that your Personal Data collected and retained by us is misleading, inaccurate, incomplete or outdated, you may request that we correct and/or update your personal data as appropriate.
8. Right to report non-compliance to the regulator: If you discover that Sanofi, or its employees, or Affiliates, or third parties, or data processors violated or failed to comply with the Laws, you may report the same to the regulator pursuant to the regulations prescribed by the Personal Data Protection Commission.

By accepting this Notice, you confirm that you have read, understood and agreed to the terms and conditions as provided herein. You freely and voluntarily give consent to Sanofi to the collection, retention, use, transfer, disclosure and processing of Personal Data, in the manners and for the purposes set out in this Notice. ประกาศคุ้มครองข้อมูลส่วนบุคคล (“ประกาศ”) ฉบับนี้อธิบายวิธีที่บริษัทซาโนฟี่-อเวนตีส (ประเทศไทย) จำกัดและบริษัทในเครือ (ตามคำนิยามด้านล่าง) (เรียกรวมกันและแยกจากกันว่า “ซาโนฟี่” “เรา” หรือ “ของเรา”) เก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน (ตามคำนิยามด้านล่าง) (“ท่าน” หรือ “ของท่าน”) เพื่อคุ้มครองความเป็นส่วนตัวของข้อมูลส่วนบุคคลของท่าน

เพื่อวัตถุประสงค์แห่งประกาศฉบับนี้ “ข้อมูลส่วนบุคคล” หมายถึงข้อมูลใด ๆ ที่เกี่ยวข้องกับตัวบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อมตามคำนิยามในกฎหมาย “บริษัทในเครือ” หมายถึง (1) บริษัท ซาโนฟี่ ปาสเตอร์ จำกัด (2) บริษัท ซาโนฟี่ วินทรอป (ประเทศไทย) จำกัด (3) บริษัท โอเพลล่า เฮลท์แคร์ (ประเทศไทย) จำกัด และ (4) บริษัทหรือองค์กรใดที่อยู่ภายใต้การควบคุม ที่ควบคุมหรืออยู่ภายใต้การควบคุมเดียวกันกับบริษัทซาโนฟี่-อเวนตีส (ประเทศไทย) จำกัด คำว่า “ที่ควบคุม” “อยู่ภายใต้การควบคุม” หรือ “ควบคุม” หมายถึง (ก) การถือหุ้นที่มีสิทธิออกเสียงในบริษัทหรือองค์กรมากกว่าร้อยละห้าสิบ (50%) ไม่ว่าทางตรงหรือทางอ้อม หรือ (ข) การมีอำนาจในการสั่งการหรือกำหนดทิศทางในการบริหารจัดการหรือนโยบายต่าง ๆ ในบริษัทหรือองค์กรดังกล่าวผ่านการถือหุ้นหรือผลประโยชน์ ไม่ว่าด้วยสัญญาหรืออื่น ๆ

หากท่านปฏิเสธไม่ให้ข้อมูลส่วนบุคคลของท่าน หรือไม่ให้ความยินยอมแก่ซาโนฟี่ในการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลของท่าน ซาโนฟี่อาจไม่สามารถติดต่อสื่อสารกับท่านได้หรือไม่สามารถตอบกลับคำขอของท่านสำหรับข้อมูลสินค้าและบริการของซาโนฟี่

ประเภทของข้อมูลส่วนบุคคลที่เก็บรวบรวมและวิธีการเก็บรวบรวมข้อมูล

ข้อมูลส่วนบุคคลที่ซาโนฟี่เก็บรวบรวมได้แก่ข้อมูลเกี่ยวกับตัวท่านที่ท่านให้ไว้แก่เราเมื่อท่านติดต่อกับเราไม่ว่าจะโดยต่อหน้า ทางโทรศัพท์ เป็นลายลักษณ์อักษร รวมถึงทางอีเมล หรือทางออนไลน์ หรือทางระบบอิเล็กทรอนิกส์ ข้อมูลดังกล่าวอาจรวมถึง แต่ไม่จำกัดเฉพาะ ชื่อ นามสกุล หมายเลขโทรศัพท์ ที่อยู่อาศัย สถานที่ทำงาน ที่อยู่อีเมล ข้อมูลและประสบการณ์ด้านอาชีพ (เช่น ความเชี่ยวชาญเฉพาะด้าน การฝึกอบรม สถานที่ทำงานและองค์กรที่เกี่ยวข้อง ตำแหน่ง ฯลฯ) ข้อมูลทางเทคนิคเกี่ยวกับอุปกรณ์ของท่าน (เช่น IP address, IMIE, cookie ฯลฯ) และข้อมูลอื่นใดที่ท่านต้องการแบ่งปันกับเรา ซึ่งข้อมูลเหล่านี้ถือได้ว่าเป็นข้อมูลส่วนบุคคล

ซาโนฟี่อาจเก็บรวบรวมข้อมูลส่วนบุคคลจากหลายแหล่ง เช่น

1. ข้อมูลที่ท่านให้ไว้แก่เราผ่านสื่อและช่องทางต่าง ๆ ไม่ว่าทางวาจาหรือโดยลายลักษณ์อักษร หรือทางระบบอิเล็กทรอนิกส์ หรือผ่านปฏิสัมพันธ์กับซาโนฟี่ไม่ว่าทางตรงหรือทางอ้อม เช่น การลงทะเบียนในงานกิจกรรม คำขอข้อมูลที่ท่านส่งถึงซาโนฟี่ ประสบการณ์ของท่านจากการใช้สินค้าและ/หรือบริการ เว็บไซต์ แพลตฟอร์ม และคุกกี้ของซาโนฟี่
2. ข้อมูลที่ซาโนฟี่เก็บรวบรวมตามกฎหมายจากแหล่งข้อมูลที่เปิดเผยต่อสาธารณะ เช่น ข้อมูลที่ท่านเป็นผู้เผยแพร่ต่อสาธารณะ และ
3. ข้อมูลที่ซาโนฟี่ได้รับโดยถูกต้องตามกฎหมายจากบุคคลที่สามที่ได้รับอนุญาตให้เก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลของท่านตามกฎหมาย

วัตถุประสงค์ในการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และประมวลผลข้อมูลส่วนบุคคลของท่าน

ซาโนฟี่และบริษัทในเครือ (และบุคคลที่สามที่อาจกระทำการแทนซาโนฟี่) อาจเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ตามที่กฏหมายอนุญาตให้ดำเนินการได้และตามวัตถุประสงค์ต่อไปนี้

1. เพื่อปฏิบัติตามภาระหน้าที่ตามกฎหมายของซาโนฟี่ ตรวจสอบดูแลความปลอดภัยเกี่ยวกับสินค้า จัดการกับเหตุการณ์ที่ไม่พึงประสงค์และข้อร้องเรียนต่าง ๆ เกี่ยวกับสินค้าและงานกิจกรรม ปฏิบัติตามกฎระเบียบ แนวทางปฏิบัติ หลักปฏิบัติ และหน้าที่ด้านความโปร่งใสและการรายงานข้อมูล รวมถึงการพิสูจน์ความถูกต้องของข้อมูล
2. ดำเนินการต่าง ๆ เพื่อป้องกัน ตรวจสอบ และแก้ไขปัญหาด้านธุรกิจ สินค้า และบริการของซาโนฟี่ รวมถึงที่เจ้าหน้าที่รัฐร้องขอ และประเมินการปฏิบัติตามกฎหมาย
3. ดำเนินกิจการต่าง ๆทางธุรกิจ ซึ่งรวมถึง การติดต่อสื่อสารกับท่านเกี่ยวกับการขาย ข้อเสนอพิเศษ การส่งเสริมการขาย การบอกกล่าว ข่าวสาร และข้อมูลเกี่ยวกับสินค้าและบริการของซาโนฟี่ ตอบกลับคำขอของท่าน ให้ท่านเข้าถึงข้อมูลทางการแพทย์และวิทยาศาสตร์ งานกิจกรรม การประชุม และบริการออนไลน์ต่าง ๆ การวางแผน ดำเนินการ และประเมินเกี่ยวกับผลการดำเนินการและกิจกรรมด้านการตลาดและธุรกิจ
4. ปฏิบัติตามภาระหน้าที่ตามกฎหมายและตามสัญญาที่มีกับท่าน เช่น ประมวลผลการชำระเงิน ติดตามจัดเก็บบันทึกการปฏิสัมพันธ์และการประชุมต่าง ๆ ระหว่างท่านและเรา รวมถึงเมื่อท่านติดต่อเราเพื่อให้คำติชม ขอข้อมูล และขอความช่วยเหลือสนับสนุน
5. ทำการศึกษาและพัฒนา รวมถึงทำการศึกษา จัดเก็บข้อมูลและทำการทดลองทางคลินิก เสนอโปรแกรมพิเศษ กิจกรรม การทดลอง งานกิจกรรม หรือการประชาสัมพันธ์ต่าง ๆ ผ่านบริการของเรา
6. ทำการศึกษาด้านการตลาดและผู้บริโภค กำหนดและวิเคราะห์แนวโน้มทางธุรกิจและการใช้สินค้าและบริการ ปรับปรุงและพัฒนาธุรกิจ สินค้าและบริการของซาโนฟี่ ปรับปรุงการจัดหาสินค้าและบริการของซาโนฟี่

การโอนข้อมูลส่วนบุคคลและการประมวลผลข้อมูลส่วนบุคคลโดยบุคคลที่สาม

ซาโนฟี่เก็บรวบรวมข้อมูลส่วนบุคคลของท่าน และจากนั้นจึงแบ่งปันและประมวลผลข้อมูลส่วนบุคคลของท่านกับพนักงานและบริษัทในเครือของซาโนฟี่ โดยให้เป็นไปตามวัตถุประสงค์ที่ระบุในประกาศฉบับนี้เท่านั้น เราจะดำเนินการให้แน่ใจว่าเฉพาะพนักงานของซาโนฟี่และบุคคลที่สามที่มีสิทธิเข้าถึงข้อมูลส่วนบุคคลจะเป็นไปตามหลักการว่าด้วยความจำเป็นในการทราบข้อมูล (need-to-know basis)

ซาโนฟี่อาจแบ่งปันข้อมูลส่วนบุคคลของท่านกับบุคคลที่สาม เพื่อวัตถุประสงค์ที่ระบุในประกาศฉบับนี้ โดยรวมถึงบุคคลต่อไปนี้

1. พันธมิตรทางธุรกิจ ผู้ให้บริการ ตัวแทน หรือผู้รับจ้าง องค์กรหรือบุคคลที่ซาโนฟี่หรือบริษัทในเครือว่าจ้างหรือจะว่าจ้าง หรือที่ให้บริการในนามของซาโนฟี่ บริษัทในเครือ หรือพันธมิตรทางธุรกิจของเรา
2. บุคคลอื่น ในกรณีที่มีการฟื้นฟูกิจการ การควบรวมกิจการ การโอนธุรกิจไม่ว่าส่วนหนึ่งหรือทั้งหมด การขาย การซื้อ การร่วมทุน การมอบ การโอน หรือการจำหน่ายส่วนใดส่วนหนึ่งหรือทั้งหมดของธุรกิจ ทรัพย์สิน หรือหุ้นของซาโนฟี่ หรือธุรกรรมอื่นใดที่คล้ายกัน
3. ที่ปรึกษาจากภายนอก ซึ่งรวมถึงทนายความ ผู้ชำนาญการ และผู้สอบบัญชีที่ช่วยเหลือเราในการดำเนินธุรกิจ และการต่อสู้หรือการใช้สิทธิเรียกร้องตามกฎหมาย
4. ผู้ประมวลผลข้อมูลส่วนบุคคลรายอื่นที่เข้าทำสัญญาการประมวลผลข้อมูลส่วนบุคคลกับเรา เพื่อประมวลผลข้อมูลส่วนบุคคลของท่านภายใต้คำสั่งของเราอย่างเคร่งครัด

บุคคลที่สามดังกล่าวอาจมีสิทธิเข้าถึงข้อมูลส่วนบุคคลที่จำเป็นต้องใช้เพื่อปฏิบัติหน้าที่ของตนเอง แต่จะไม่สามารถใช้ข้อมูลส่วนบุคคลเพื่อการอื่นได้นอกจากเพื่อกระทำการแทนเราและจะดำเนินการให้เป็นไปตามสัญญาระหว่างซาโนฟี่หรือบริษัทในเครือและบุคคลที่สามที่เกี่ยวข้องซึ่งรักษาความลับของข้อมูลส่วนบุคคลของท่าน

การโอนข้อมูลส่วนบุคคลไปต่างประเทศ

เพื่อวัตถุประสงค์ของประกาศฉบับนี้ อาจมีการโอนข้อมูลส่วนบุคคลของท่านให้กับบริษัทในเครือของซาโนฟี่ในต่างประเทศ พนักงานที่ได้รับมอบอำนาจ ผู้ให้บริการ บุคคลที่สามที่อยู่ต่างประเทศ และฐานปฏิบัติการด้านเทคโนโลยีสารสนเทศและเซิร์ฟเวอร์ที่ตั้งอยู่ต่างประเทศ ทั้งนี้โดยเป็นไปตามเงื่อนไขที่กฎหมายกำหนด

สำหรับการโอนข้อมูลส่วนบุคคลภายในกลุ่มบริษัทเพื่อการศึกษาทางคลินิกและการเฝ้าระวังความปลอดภัยด้านยา ซาโนฟี่ได้ดำเนินการและบังคับใช้ “กฎเกณฑ์การคุ้มครองข้อมูลส่วนบุคคลภายในองค์กร” ที่ได้รับการรับรองโดยหน่วยงานคุ้มครองข้อมูลส่วนบุคคลของสหภาพยุโรป แต่ในทุกกรณี การเก็บรวบรวม เก็บรักษา ใข้ โอน เปิดเผย และประมวลผลข้อมูลส่วนบุคคลของท่านโดยซาโนฟี่และบริษัทในเครือจะยังคงอยู่ภายใต้ประกาศฉบับนี้

หากข้อมูลส่วนบุคคลของท่านถูกโอนไปยังประเทศปลายทางที่อาจไม่มีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่ “เพียงพอ” ตามมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่กฎหมายกำหนด ซาโนฟี่จะจัดให้มีการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอตามที่กฎหมายของประเทศปลายทางกำหนด และมีมาตรการคุ้มครองที่เหมาะสม

การจัดเก็บ/การเก็บรักษา/การจำหน่าย/การทำลาย/การไม่ระบุตัวตนเจ้าของ ของข้อมูล

ซาโนฟี่จัดเก็บข้อมูลส่วนบุคคลในสภาพแวดล้อม ฐานข้อมูล และเครื่องมือที่มั่นคงปลอดภัย ซึ่งจะมีเพียงพนักงาน ตัวแทน บริษัทในเครือ และบุคคลที่สามที่ซาโนฟี่อนุญาตเท่านั้นจึงจะเข้าถึงข้อมูลส่วนบุคคลได้ ซาโนฟี่จัดเก็บข้อมูลส่วนบุคคลของท่านโดยยึดตามมาตรฐานและหลักปฏิบัติทางอุตสาหกรรมซึ่งเป็นที่ยอมรับกันโดยทั่วไปหรือตามที่กฎหมายกำหนด ซาโนฟี่จะใช้มาตรการทางเทคนิค (technical measures) และมาตรการด้านการจัดโครงสร้างองค์กร (organizational measures) ที่เหมาะสมเพื่อรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลและปกป้องข้อมูลส่วนบุคคลของท่านจากความสูญหาย การเข้าถึง การแก้ไข การใช้ การเปลี่ยนแปลง การเปิดเผย การลบหรือการประมวลโดยไม่ได้รับอนุญาต ซาโนฟี่จะกำหนดให้พนักงาน ตัวแทน บริษัทในเครือ และบุคคลที่สามที่ประมวลผลข้อมูลส่วนบุคคลปฏิบัติตามข้อกำหนดภายใต้ประกาศฉบับนี้และบทบัญญัติแห่งกฎหมาย

ซาโนฟี่จะเก็บรักษาข้อมูลส่วนบุคคลของท่านเป็นเวลาไม่เกินสิบ (10) ปี เพื่อจุดประสงค์ในการทำการจัดเก็บบันทึกข้อมูล และจะเก็บรักษาข้อมูลส่วนบุคคลไว้นานตราบเท่าที่จำเป็นต่อวัตถุประสงค์ที่กล่าวข้างต้นและเท่าที่กฎหมายและกฎเกณฑ์ต่าง ๆ กำหนด

หลังจากระยะเวลาที่เกี่ยวข้อง หรือเมื่อไม่จำเป็นต้องใช้ข้อมูลส่วนบุคคลนั้นอีกต่อไปแล้ว ซาโนฟี่และ/หรือพนักงาน ตัวแทน บริษัทในเครือหรือบุคคลที่สามจะทำลาย ลบ หรือจำหน่ายข้อมูลส่วนบุคคลดังกล่าวอย่างปลอดภัย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวตนท่านได้ โดยยึดตามมาตรฐานและหลักปฏิบัติที่เป็นที่ยอมรับโดยทั่วไป

สิทธิของท่านในฐานะเจ้าของข้อมูลส่วนบุคคล

ท่านมีสิทธิตามกฎหมายดังต่อไปนี้ ภายใต้เงื่อนไขและข้อยกเว้นทางกฎหมายที่ใช้บังคับ

1. สิทธิที่จะถอนความยินยอมของท่าน: ในกรณีที่ท่านได้ให้ความยินยอมแก่เราเพื่อทำการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน ท่านมีสิทธิที่จะถอนความยินยอมเสียเมื่อใดก็ได้ เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอม ไม่ว่าจะโดยกฎหมายหรือสัญญาที่ให้ประโยชน์บางอย่างแก่ท่าน อย่างไรก็ตาม การถอนความยินยอมจะไม่ส่งผลกระทบย้อนหลังต่อการเก็บรวบรวม เก็บรักษา ใช้ เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่านที่ได้กระทำไปแล้วก่อนการถอนความยินยอม
2. สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน: ท่านมีสิทธิที่จะขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมและเก็บรักษาไว้ ท่านยังสามารถที่จะขอให้เราเปิดเผยถึงแหล่งที่มาของข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมโดยที่ท่านไม่ได้ให้ความยินยอม (ถ้ามี)
3. สิทธิในการย้ายข้อมูล: ภายใต้ขอบเขตที่กฎหมายกำหนด ท่านมีสิทธิที่จะขอรับสำเนาข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวมและเก็บรักษาไว้ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติและสามารถใช้หรือเปิดเผยได้ด้วยวิธีการอัตโนมัติ ท่านยังสามารถขอให้เราส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นหรือให้แก่ท่าน เมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ หากว่าโดยสภาพทางเทคนิคสามารถทำได้
4. สิทธิในการคัดค้านการประมวลผลข้อมูลส่วนบุคคลของท่าน: ท่านมีสิทธิที่จะคัดค้านการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน ภายใต้เหตุอันชอบด้วยกฎหมายของซาโนฟี่ (เว้นแต่ว่าซาโนฟี่สามารถพิสูจน์ให้เห็นถึงเหตุอันชอบด้วยกฎหมายที่ใช้บังคับสำหรับการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผล นั้นมีความจำเป็นสำหรับซาโนฟี่เพื่อก่อตั้งสิทธิเรียกร้อง การใช้สิทธิเรียกร้องหรือการปฏิบัติตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย) หรือการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่านได้ถูกดำเนินการเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง
5. สิทธิในการลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านไม่สามารถระบุตัวตนท่านได้: ท่านมีสิทธิที่จะขอให้เราดำเนินการลบ หรือทำลาย หรือทำให้ไม่สามารถระบุตัวตนท่านได้ สำหรับข้อมูลส่วนบุคคลของท่านที่เราได้เก็บรวบรวมและเก็บรักษาไว้ โดยเมื่อ (1) ข้อมูลส่วนบุคคลของท่านหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผล (2) ท่านถอนความยินยอมในการการเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน และซาโนฟี่ไม่มีอำนาจอันชอบด้วยกฎหมายที่จะกระทำการดังกล่าวต่อไป (3) ท่านคัดค้านเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลข้อมูลส่วนบุคคลของท่าน และซาโนฟี่ไม่มีสิทธิในการปฏิเสธคำขอของท่าน หรือ (4) ข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลโดยไม่ชอบด้วยกฎหมาย
6. มีสิทธิในระงับการใช้ข้อมูลส่วนบุคคลของท่าน: ท่านมีมีสิทธิขอให้ระงับการใช้ข้อมูลส่วนบุคคลของท่านได้ภายใต้กรณีดังต่อไปนี้ (1) ในขณะที่ซาโนฟี่อยู่ระหว่างการแก้ไขหรือทำให้ข้อมูลส่วนบุคคลของท่านถูกต้องเป็นปัจจุบัน (2) ข้อมูลส่วนบุคคลของท่านถูกเก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และ/หรือประมวลผลโดยไม่ชอบด้วยกฎหมาย แต่ท่านขอให้ระงับการใช้แทนการลบ (3) เมื่อข้อมูลส่วนบุคคลของท่านไม่มีความจำเป็นอีกต่อไปในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล แต่ท่านมีความจำเป็นต้องขอให้เก็บรักษาไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การใช้สิทธิเรียกร้องหรือการปฏิบัติตามตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือ (4) เมื่อซาโนฟี่อยู่ในระหว่างการตรวจสอบเพื่อปฏิเสธคำคัดค้านการประมวลผลข้อมูลส่วนบุคคลของท่าน ภายใต้เหตุอันชอบด้วยกฎหมายของซาโนฟี่
7. สิทธิในการแก้ไขข้อมูลส่วนบุคคลของท่าน: เมื่อท่านพบว่าข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวมและเก็บรักษาไว้นั้นก่อให้เกิดความเข้าใจผิด ไม่ถูกต้อง ไม่สมบูรณ์ หรือไม่เป็นปัจจุบัน ท่านสามารถที่จะขอให้เราทำการแก้ไข และ/หรือทำให้ข้อมูลส่วนบุคคลของท่านถูกต้องเป็นปัจจุบันตามเหมาะสม
8. สิทธิร้องเรียนในกรณีที่มีการปฏิบัติไม่ถูกต้องต่อหน่วยงานรัฐที่มีอำนาจควบคุม: เมื่อท่านพบว่าซาโนฟี่ หรือพนักงานของซาโนฟี่ หรือบริษัทในเครือ หรือบุคคลที่สาม หรือผู้ประมวลผลข้อมูล ฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมาย ท่านสามารถรายงานการกระทำดังกล่าวต่อหน่วยงานรัฐที่มีอำนาจควบคุมตามกฎเกณฑ์ที่กำหนดโดยคณะกรรมการคุ้มครองข้อมูลสวนบุคคล

ความยินยอมของท่าน

โดยการยอมรับประกาศฉบับนี้ ท่านยืนยันว่าท่านได้อ่าน เข้าใจ และตกลงตามข้อกำหนดและเงื่อนไขของประกาศฉบับนี้ ท่านให้ความยินยอมแก่ซาโนฟี่โดยสมัครใจให้ซาโนฟี่เก็บรวบรวม เก็บรักษา ใช้ โอน เปิดเผย และประมวลผลข้อมูลส่วนบุคคล โดยใช้วิธีและเพื่อวัตถุประสงค์ที่ระบุในประกาศฉบับนี้ ท่านตกลงว่าซาโนฟี่หรือตัวแทนที่ได้รับอนุญาตสามารถติดต่อท่านได้โดยตรงหรือผ่านช่องทางการติดต่อที่ท่านได้แจ้งไว้หรือผ่านช่องทางอื่นที่ท่านตกลงให้ทำการติดต่อท่าน

หากต้องการข้อมูลเพิ่มเติมเกี่ยวกับสิทธิของท่าน และหากมีคำขอใด ๆ เกี่ยวกับข้อมูลส่วนบุคคลของท่านและนโยบายความเป็นส่วนตัวของซาโนฟี่ กรุณาติดต่อเราหรือเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคลของซาโนฟี่ในวันและเวลาทำการ วันจันทร์-วันศุกร์ (ยกเว้นวันหยุดราชการ) ตั้งแต่ 8.30 น. - 17.30 น.
